JetShare Terms & Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://jetshareapp.com website (the “Service”) operated by Airly Group Pty Ltd (“us”, “we”, or “our”).  Civil Aviation Safety Authority (hereinafter referred to as “CASA”) approved Air Operator Certificate holders shall be referred to as “Operator” or “Operators”.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

GENERAL
1.1  The user accepts that we are solely a booking agent and do not own or operate aircraft.
1.2  The user accepts responsibility for liaising with the Operator following the purchase of a flight.  We will not be held liable for any losses incurred by a lack of communication.

EXERCISE OF CONTROL
2.1  The Operator exercises full operational control of the aircraft.
2.2  The Operator reserves the right to refuse access to aircraft by persons in accordance with CASA regulations and orders, and requirements of the Civil Aviation Act 1988.

PURCHASES
3.1  A user’s share on a flight is not confirmed till a receipt of payment has been received by us and/or Stripe.
3.2  The user cannot purchase a JetShare flight on behalf of another party.  The Operator reserves the right to verify identification of the user and passengers.
3.3  The amount of seats purchased directly reflects the number of passengers accompanying the user.  The user is responsible, when requested by the operator, to provide additional information on guests travelling with the user.

CHANGES AND CANCELLATIONS
4.1  JetShare flights may experience last minute change or cancellation, due to operational demand or by request.  Should a JetShare flight be modified post-purchase, the user will have the option to accept the modification(s) if operationally possible, or accept a refund.
4.2  The user may modify or cancel their purchase of a flight, or share of a flight, provided it is done so within the allowable purchase and cancellation windows set by the Operator.  The purchase and cancellation windows can be found on the individual flight details page above the Operator’s ABN and address.
4.3  The user cannot change their name following the purchase of a JetShare flight.
4.4  The user may request modifications of a JetShare flight to the operator.  We, and the Operator, will not be held liable for any losses incurred should the said request not be fulfilled.

REFUNDS
5.1  The annual JetShare access fee of $99.00 AUD is non-refundable.
5.2  All refunds will be processed within 10 business days of the cancellation being made.
5.3  Refer to Schedule One for refund scenarios.

YOUR FLIGHT
6.1  The user and the user’s guests must arrive at the lounge / departure location specified by the operator no later than 15 minutes prior to the agreed departure time.
6.2  The user agrees to make all efforts to be punctual and if delayed, inform the operator immediately.
6.3  If the user is delayed, the operator reserves the right to depart without you if operationally necessary.  This scenario is referred to as a “No show / late arrival” and there will be no refunds.
6.4  The user may not bring additional passengers without the consent of the Operator.
6.5  Pets are not allowed on the flight without the consent of the Operator.
6.6  The user accepts the carriage conditions set by the Operator including dangerous goods and security policies.

RESPECTFUL USE
7.1  The user agrees to treat the aircraft, helicopter, lounge and any other assets owned or serviced by the Operator with the greatest of respect.
7.2  The user accepts responsibility of the actions of their guests and will be liable for all losses, damages caused by the user and their guests. This includes any financial impact on assets, aircraft, helicopters or revenue lost on a subsequent charter.
7.2  We, in conjunction with the operator, reserve the right to revoke your access to the Service.

LIABILITY
8.1  We are not liable for death of or injury to any person, for loss of or damage to baggage or goods, for delay, or for consequential or other loss of any kind, arising directly or indirectly from negligence or omission or some other cause in connection with provision or non-provision of any transport or service arising out of the user’s use of the Service.
8.2  We are not liable for any inaccuracy in any information concerning the JetShare flight.
8.3  By using the Service, the user agrees to indemnify us against any and all claims, demands, suits, actions, awards, judgements, damages and losses which may arise out of any transport or service provided by any Carrier.

CASH BACK OFFER
9.1  The cash back offer is for the value of up to $99 which will be applied to the user’s first seat or trip purchase.
9.2  The user’s credit card will be charged in full with the cash back amount being applied via manual refund.
9.3  The refund will be processed 5-10 business days following the completion of their trip.
9.4  The cash back offer may only be claimed once and is non-transferrable.
9.5  The cash back offer only applies to members who paid their join fee prior to 12:01AM on the 7th of September 2017.

WE WANT YOU TO BE HAPPY
10.1  Users can exercise their right to a 30 (thirty) day money back guarantee.
10.2  Should the user not be satisfied with the product, they may contact JetShare Concierge via message or email [email protected] detailing they wish to have their access fee refunded.
10.3  The access fee will be refunded in full 5-10 business days following the request for a refund.
10.4  Refunds will not be considered 31 days post-registration.
10.5  Once the refund has been processed the user’s account will have limited functionality.

* Does not include the difference of what the user paid per seat against the listed price per seat.  Should the user save by purchasing the full share, and then cancel a single seat, we will deduct the difference saved and exclude it from the refund.
